Wakalah(authorization) is when someone authorizes someone else to perform a lawful task on his behalf, so he can buy and sell, but not as if it is for himself(authorized), therefore, his actions must be for the benefit of the authorizer.

Moreover, there is a consensus among Muslim scholars that the authorized is entrusted with achieving the benefit of his authorizer.

Allah’s Messenger ﷺ said:
“Pay the deposit to him who deposited it with you” (Narrated by Abu Daud and Tirmizi).

An-Nawawi (May Allah be pleased with him) said:
“Wakalah takes the ruling of a trust since the authorized is trustworthy, and he isn’t required to give a compensation, except in case of misconduct and negligence.” (Rawdat At-Talibeen, 4/325).

Moreover, Al-Imam Ar-Ramli (May Allah be pleased with him) said:
“A guardian does what is beneficial to the one under his guardianship and an authorized does what is beneficial to the one who had authorized him”(Asna-Al-Matalib, 2/46).

Accordingly, if the authorized acted against the benefit of the authorizer, then his action is null and void. Some examples of such acts are: non-adherence to the conditions of the authorizer, or selling against deferred payment without his approval or selling with grave deception, and the like.” (Moghni Al-Mohtajj, 3/243).

And Allah knows best.

FAQ: Aqiqah in General

An Aqiqah is the animal or animals that are slaughtered on the seventh day after the birth of a baby.

From Samurah (RA) that Allah’s Messenger ﷺ said:

“A child is held in pledge by his Aqiqah that is slaughtered on his behalf on the seventh day, the harm is removed from him (i.e. the head is shaved) and he is named.”

(Narrated by Ahmad (7/5), Abu Daud (2838), At-Tirmidzi (1522). It was graded Sahih by: At-Tirmidzi, Al-Hakim, Abdur-Razaq Al-Ishbele and others.)

Ibn Mundhir (RA) stated:

“It is a custom established in the Hijaz region past and present, and practiced by the Scholars. Malik (d.179H) mentioned that it is an affair concerning which there is no differing amongst them. From those who held that the Aqiqah should be done is: Abdullah Ibn Abbas, Abdullah Ibn Umar and A’ishah, the Mother of the Believers (RA).

A large body of scholars have followed in this, the Sunnah of Allah’s Messenger ﷺ — and when it is established in the Sunnah, then it becomes incumbent to speak with it — and this practice is not harmed by those who turn away from it.

Abu Zinadah (rahimahullaah) said:

“The Aqiqah is an affair practiced by the Muslims and leaving it off was hated.”

Ahmad Ibn Hanbal (d.241H):

“I do not like that a person who has the ability to perform an Aqiqah on behalf of his child, yet he does not do so. It should not be left because the Prophet ﷺ said: “The child is held in pledge by his Aqiqah” And this is the severest of what has been narrated in this affair.”

(Tuhfatul-Mawdud bi Ahkamil-Mawlud, 100-102)

Al-Harith said to Abu Abdillah Ahmad Ibn Hanbal: “What if a person does not have something to slaughter?” He replied:

“If he was to take a loan, I have hope that Allah will replace it for him due to him giving life to the Sunnah.”

At-Tirmidhee (rahimahullaah) said:

“Acting upon this affair with the Scholars: is that the Aqiqah is slaughtered on behalf of the child on the seventh day – and if it is not possible on the seventh day, then on the fourteen. And if that is not possible, then on the twenty first day.”

(As-Sunan 4/86)

This order is reported from the Prophet ﷺ

Reported by At-Tabaraani in Al-Awsat (4882), Majma` az-Zawaa’id (4/59). It was authenticated by Ad-Diyaa’ from the hadeeth of Buraidah; and it is supported by the hadeeth of A’ishah (RA) reported by Al-Hakim in Al-Mustadrak (4/238-239))

Umm Kurz Al-Ka`biyah (RA) said: I heard Allah’s Messenger ﷺ say:

“On behalf of the boy there are two equivalent sheep, and for the girl just one.”
